ECJ ruling on Body-Cams: What the ruling means for GDPR-compliant use

The most important things in brief

In its judgment of December 18, 2025, the European Court of Justice made a groundbreaking decision regarding the use of Body-Cams in Europe. At its core, it concerns the question: What data protection information obligations apply when ticket inspectors, security personnel, or other employees wear body cameras?

The ECJ’s answer is clear: Art. 13 GDPR is applicable. This means that affected persons must be informed immediately at the time of recording and not only subsequently as with Art. 14 GDPR.

The judgment thus confirms a line that we at NetCo have been advocating for years: GDPR-compliant Body-Cam use is not only possible, but also mandatory for the protection of passenger rights as well as for the admissibility of evidence in court.

Initial situation: 355,000 euro fine in Stockholm

Since December 2018, the Swedish transport company AB Storstockholms Lokaltrafik (SL) has equipped its ticket inspectors with Body-Cams. The goals were understandable: to document threatening situations, prevent assaults, and identify passengers without valid tickets. A concern that is gaining importance in view of increasing acts of violence against public transport personnel throughout Europe.

However, in June 2021, the Swedish Data Protection Authority imposed a fine of around 355,000 euros. The accusation: Passengers were not informed about the data processing in accordance with Art. 13 GDPR.

The transport company argued that this was data collection within the meaning of Art. 14 GDPR, since the passengers did not actively provide their data. The Supreme Administrative Court of Sweden finally submitted the question to the ECJ.

The core statements of the ECJ ruling

Article 13 GDPR is applicable – not Article 14

The ECJ clarifies: If a person is recorded by a Body-Cam, they themselves are the source of the data. The data is collected directly from the data subject, even if they are neither actively acting nor aware of the recording.

Article 14 GDPR only applies if the controller has no direct contact with the data subject and receives the data from another source. This is not the case with Body-Cams.

The information must be provided immediately

According to Art. 13 para. 1 GDPR, the information must be provided “at the time of collection.” The ECJ emphasizes: Subsequent information is generally not sufficient for Body-Cams. Those affected should be able to understand as early as possible that filming is taking place and for what purpose.

The Court warns: Without timely information, there is a risk of covert surveillance practices. This constitutes a violation of Articles 7 and 8 of the EU Charter of Fundamental Rights.

Practical implementation: The layered information model

The ECJ refers to the Guidelines 3/2019 of the European Data Protection Board (EDPB) on video surveillance. According to these guidelines, the obligation to provide information can be fulfilled in a multi-layered procedure:

Level 1: On-site note

The most important information must be immediately visible – for example, on a sign in the vehicles, on the uniform of the inspection personnel, or via a signal light on the Body-Cam. The core information includes:

Name and contact details of the responsible person
Purpose of data processing (e.g., protection of personnel, de-escalation)
Legal basis for processing
Recipients of the data
Storage duration of recordings
Reference to rights to information and deletion

Level 2: Complete Data Protection Information

The complete mandatory information can be made available in an easily accessible location, such as via QR code on the information sign, posted in the vehicles, or on the transport company’s website.

De-escalation instead of mere documentation

The ECJ ruling strengthens information obligations but does not question the fundamental usefulness of Body-Cams. On the contrary, when used correctly, body cameras are an effective tool for de-escalation and for protecting staff.

The numbers speak for themselves: At Deutsche Bahn alone, over 75,000 acts of violence against employees have been recorded since 2022. The Railway and Transport Union (EVG) expressly supports the use of Body-Cams as a preventive measure.

Do passengers have to consent to the Body-Cam recording?

No. The recording can be made on the basis of a legitimate interest according to Art. 6 para. 1 lit. f GDPR. Consent is not required – but information according to Art. 13 GDPR is.

Does the ruling also apply to pre-recording functions?

Yes. As soon as the camera is activated and image data is captured, data collection is taking place. The NetCo Body-Cam offers a pre-recording function of up to 120 seconds – ensuring that crucial moments are always captured, even if the recording starts later.

Can Body-Cam recordings be used in court?

Pre-Recording Body-Cams

Bodycams have become an important tool for promoting transparency and de-escalation in the deployment of security forces. A key technology integrated into these devices is so-called pre-recording. This function allows the camera to constantly record the last few seconds or minutes, even if the record button has not yet been pressed. This can be crucial for documenting important events before the camera is activated.

What is Pre-Recording?

Pre-recording is a function in bodycams in which the camera continuously saves a certain period of time before the actual recording. This period of time can usually be between 15 seconds and 2 minutes, depending on the camera model and settings. If the recording function is activated manually, the previously recorded seconds are also saved. Otherwise, they are deleted automatically. This technique ensures that the context prior to an incident is also recorded, which can be of great importance for the reconstruction of events and for evidence purposes.

Police laws and regulations in Europe

Bodycams at major events: Cameras support Cologne carnival

Shortly after the start of the Body-Cam Pilot test phase at the City of Cologne, the municipality is already drawing positive conclusions about body cams: the field staff of the public order office have benefited from the use of the cameras, especially on carnival days. In particular, the front screen of the tested cameras – including the NetCo Body-Cam – had a de-escalating effect on the revelers: “By wearing the Bodycam with front screen, it was found that those affected adapted their behaviour and became more cooperative,” a spokeswoman for the city of Cologne announced shortly after the carnival (source: New devices in use: Bodycam helped Cologne public order office at carnival in action against troublemakers (msn.com)).

The area in which the body cams were used was extended during the carnival days: while the cameras are normally only used around the cathedral/main train station and the old town, the field staff now also wore the body cams in the Zülpich district in order to de-escalate conflicts and protect other revelers.

The body cams were in use on carnival days – and not just in the cathedral area, but in all “hotspots” in the city. The general pilot phase will last for a total of 6 months. In addition to the NetCo Body-Cam, other models will also be tested. After the test phase and a subsequent evaluation, a decision will be made as to whether the body cam will continue to be used by the field staff of the Cologne Public Order Office.

The City of Cologne attaches great importance to a well thought-out technical infrastructure. The ability to store recorded body cam data in the city’s IT network is important here in order to avoid security gaps.

Only a few body cams needed to be used at the carnival

During the test period to date, a body cam recording has only been made twice – both times during the Cologne carnival. In three cases, aggressive revelers were warned, but the body cam was not activated because the situation could be de-escalated. In one of the two cases in which the body cam recorded the situation, it was a heavily intoxicated person who was involved in a fight. The camera was switched on after a member of security staff was also attacked. The image and sound material from the body cam is now being used to preserve evidence in order to be able to successfully initiate criminal proceedings against the partygoer.

For data protection reasons in the EU, body cam recordings are deleted by default after a predefined period of time. However, indefinite storage is possible in three cases:
For the prosecution of criminal offenses and administrative offenses
To avert danger at the request of the person filmed, in the event of a request to review the legality of the body cam recording

In the case of the heavily intoxicated person who assaulted the police officer, the body cam recording is also initially stored indefinitely to enable criminal prosecution.

Body cams also helpful at other major events

It is not only at the Cologne Carnival that the experience of the public order office has shown that body cams are a promising way of de-escalating conflict-laden situations. The use of body cams is also beneficial at other major events that are accompanied by the public order office and police in order to manage potential conflicts and ensure public safety.

However, in order to be able to equip additional security personnel, for example from private security companies, with body cams for major events, a few hurdles still need to be overcome in terms of data protection. DB Regio: More safety for customer advisors on trains

Cases of violence on trains threaten the safety of train attendants and physical assaults are no longer uncommon. Situations usually escalate due to missing tickets and the threat of fines. In 2022, more than 3,000 assaults were committed against railroad employees,an increase of 21% compared to the previous year. To protect its customer service staff, DB Regio is now increasingly using body cams on its trains.

Body-Cam deployment on the Black Forest Railway

The NetCo Body-Cam has been successfully used on the Black Forest Railway since February 2023. DB Regio and the Offenburg Federal Police have launched a pilot project in which the cameras are to be used on the Black Forest Railway line for a year to make the day-to-day work of customer service staff safer. If a situation escalates, the train attendants now have the option of informing the passenger in question that the body cam can be switched on and record video footage if the situation does not calm down. The recorded video material can only be viewed by the Offenburg Federal Police and used for further prosecution. Those affected will receive an information card from the train attendants with further information and contacts.

So far, however, the de-escalating effectof the body cam has been sufficient. Valerie Fischer, train attendant on the Black Forest Railway, is delighted with the camera:

"I wouldn't give her away again"

DB Regio has also launched a similar pilot project in Bavaria. On the route from Bamberg to Würzburg, 6 railroad employees are testing the NetCo Body-Cam until the end of the year. Martina Wilk is one of the customer advisors who is allowed to wear the camera on her uniform. Since the introduction of the body cam, she has rarely been insulted and has not been physically assaulted since. She is pleased about the respect she is once again receiving from passengers with the camera and often no longer has to engage in discussions as soon as she asks for ID. Christian Postler, Team Leader Bamberg at DB Regio Bayern, also draws a positive interim conclusion about the body cam. Since the other train attendants have been wearing the body cam, there have also been no more incidents of violence.

Transdev also relies on body cams

Not only DB Regio, but also many other public transport companies such as the Transdev Group are now using body cams to protect staff. In 2022, there were 210 verbal and physical assaults at Regio-S-Bahn Bremen/Lower Saxony (Transdev) – a significant increase compared to the pre-coronavirus years. NordWestBahn is now using body cams on a trial basis. In future, 35 train attendants will wear a body cam. These will be used every day from 7 p.m., as situations are particularly likely to escalate during this time. So far, there have only been positive reactions: A NordWestBahn spokesperson announced that no video recordings had yet been made. He also confirmed the de-escalating effect of the NetCo body cam. TransRegio, part of the Transdev Group, has been using body cams on the MittelrheinBahn between Cologne and Mainz since 2019. A TransRegio customer advisor is also pleased with the de-escalating effect of the body cam: “Passengers react to it, are aware of the issue and behave accordingly. In the following interview, Thorsten Bleckmann, Head of the Municipal Field Service at the Citizens’ and Public Order Office in Duisburg, gives us exciting insights into the successful use of body cams to improve security and de-escalation in the city. Since when have the body cams been in use by the municipal service in Duisburg?

In April 2022, we started a test deployment with 20 body cams. After evaluation, we have in October 2022 finally decided to equip all employees with it.

Why did you decide to use body cams?

As the head of the municipal field service, I regularly inform myself about legislative changes that affect the work of my employees. I also pay special attention to possible innovations regarding safety equipment. After the amendment [of the law on public order authorities] was passed and the possibility for public order authorities to be able to use body cams was created, I dealt with this topic more intensively and brought it to the Duisburg administration g. Since the equipment with body cams is also associated with considerable costs, I have exchanged information with other companies (e.g. with the Deutsche Bahn), which have already used the body cams. I was particularly interested in how situations can be de-escalated through the use of body cams or how they can be prevented from escalating in the first place. I received consistently positive feedback from other companies on the subject of body cams. Subsequently, I have obtained appropriate offers from several providers. Iin a further step, the body cams were first tested by us, before it went into full equipment.

How was the testphase?

We have noticed that the cameras already have a de-escalating effect in many conversations with citizens without even being turned on. Sometimes we are asked if the camera is one and if it has already been turned on. Then we explain the multi-stage procedure for de-escalation: first, the camera is just present, then there is the option of just turning on the display, and only if the situation still hasn’t calmed down and continues to escalate do we start a recording. The feedback I have from employees is consistently positive. It happens, of course, that the camera doesn’t impress someone, for example, under the influence of drugs or mentally insane. In the case of argumentative people who are mentally clear and know exactly what they are doing, the mere presence of the camera causes them to moderate themselves and the situation, even if it has already boiled up, de-escalates another time.

Did you have any technical problems during the testphase?

In individual cases, there are cameras with which the data cannot be downloaded. We also had problems with the batteries, individual body cams did not last a whole shift. In the meantime the settings of the body cams have been changed and the batteries hold out. So there are now and then technical problems, but the support when problems arise is good.

How do people in Duisburg react to the body cams?

If they react at all, it is positive and interested. Negative reactions in actions are rare. Most often, a situation relaxes as soon as the camera is turned on.

Duisburg is the first large municipality to deploy the NetCo Body-Cam. Do you have any tips and advice for other municipalities that are also interested in using Body-Cam?

It is important that the employees and later main users are included in the considerations from the beginning. Initially, there were also reservations about the use of body cams (e.g., fear of surveillance or recording of one’s own work), but these were dispelled by the test participants after a short time. Testing was carried out in a working group of the municipal field service and by some employees of traffic monitoring. Now employees feel safer using the body cams.
Generally, when acquiring new technology or software, it is important to be open with existing information and include all stakeholders in the process. 2nd Body-Cam Conference – a complete success!

On June 14, 2023, the NetCo Body-Cam Team invited security experts from a wide range of industries – including private security services, transport companies, police forces and law enforcement agencies – to the second Body-Cam Conference in Cologne. After the first conference in the previous year (2022) was so well received by the participants, this year we were even able to top the success of the previous event and were pleased about the consistently positive feedback from the participants.

The program of the conference

Security experts could dive into interesting at the Body-Cam Conference again. We from NetCo only guided through the event. It was important to us that the program had something included for every participant, and we therefore portrayed the topic of “Body-Cam” from different perspectives.

In addition to a presentation on the data protection requirements when using a body cam (Björn Stürz Akademie // Sascha Kittelmann), we also learned how the cameras are best implemented in a security company (Dr. Harald Olschok // HOT-Consulting, Security Advisory Board of KÖTTER Security GmbH & Co. KG). KVB gave us insights into their pilot phase (Jürgen Kircher // Kölner Verkehrsbetriebe AG) and DB Sicherheit gave a presentation on the use of body cams from testing to regular operation (Marcus Schermann // DB Sicherheit GmbH). The Federal City of Bonn, which also uses and highly appreciates body cams with front display, reported on the use of the cameras in the city order service of the city of Bonn (Sascha Hessenbruch // Bundesstadt Bonn).

Mr. Servas from the Berufsgenossenschaft VBG presented the possible applications of body cams for security service providers.
Mr. Kluttig from the company LOGO Bochum GbR brought a completely different perspective to the topic: He gave the participants psychological tips for the successful implementation of body cams in service companies and authorities.

There was enough time between the presentations for the audience and speakers to talk to each other. The opportunity for networking was gratefully accepted by the participants – and even exceeded our expectations! More than once we extended the break time so that profitable conversations did not have to be interrupted.
